Zhang Ling is a minor, and his case was heard in a closed manner, but it did not hinder the media reporters who heard the news. On the day of the trial of Zhang Ling's case, the gate of the court was surrounded by media reporters and good people from all directions early in the morning.  .

But inside Sen's solemn courtroom, it was a different scene.

Prosecutor Xu Liang appeared in court on behalf of the procuratorate. He took the indictment and read: "Defendant Zhang Ling, male, born on xx.  Suspected of intentional homicide, he was detained by the Public Security Bureau of XX District. On June 28 of the same year, he was arrested with the approval of the People's Procuratorate of XX District, and executed by the Public Security Bureau of XX District on the same day.

?The case was investigated by the xx District Public Security Bureau, and the defendant Zhang Ling was suspected of intentional homicide and transferred to the xx District People's Procuratorate for review and prosecution.  The People's Procuratorate of xx District submitted it to this court for review and prosecution on August 22 of the same year.  After the court accepted the case, it has notified the defendant that he has the right to entrust a defender and the relatives of the victim that he has the right to entrust an attorney ad litem. He has interrogated the defendant and reviewed all the case materials in accordance with the law.

? After legal review, it was found that:

The victim Zhang and the defendant Zhang Ling are father and son.  On x month x, 201x, the victim Zhang was drunk, had an argument with his wife Liu Qiaopei and beat Liu Qiaopei and the defendant Zhang Ling.  The defendant Zhang Ling took a knife from the kitchen and stabbed the victim Zhang, and then chased the victim five times in a row, resulting in Zhang's death.

After the incident, the defendant Zhang Ling voluntarily surrendered to the police.

? According to the identification of the Physical Evidence Appraisal Office of the xx County Public Security Bureau: the victim Zhang died of hemorrhagic shock after the rupture of the internal carotid artery and the rupture of the maxillary artery due to a sharp instrument injury.

? The main evidence for the determination of the above facts is as follows:

? On-site inspection and inspection transcripts, identification transcripts, physical evidence such as kitchen knives, appraisal opinions, the defendant's confession and defense, and simultaneous audio and video recordings, etc.

This court believes that the defendant Zhang Ling intentionally and illegally deprived others of his life, and his behavior violated Article 232 of the "Criminal Law of the People's Republic of China".  .  According to the provisions of Article 172 of the "Criminal Procedure Law of the People's Republic of China", if a public prosecution is initiated, please sentence it according to law.

After Xu Liang finished reading the indictment, the presiding judge Peng Sheng asked: "Defendant, is the indictment read out by the public prosecutor just now consistent with the one received before?"

"Consistent." Wu You, Zhang Ling's defender, said.

"Defendant, do the allegations in the indictment exist? Are the charges established? Did you plead guilty voluntarily?" Peng Sheng asked.

"Dear presiding judge, all jurors, the facts in the indictment exist, but the defendant believes that the defendant's behavior does not meet the criminal elements of the crime of intentional homicide, so he pleads not guilty." Wu You said.

Peng Sheng said: "The public prosecutor can question the defendant."

Xu Liang stood up, greeted the collegial panel, and then asked: "Zhang Ling, on the day of the incident, after you hacked the victim for the first time, has the victim's beating of your mother been stopped?"

Zhang Ling thought for a moment and said, "It seems to have stopped, I'm not sure."

Xu Liang asked: "After that, you hacked several times, what was the reason?"

Zhang Ling said: "I'm afraid he will beat me and my mother again."

Xu Liang asked again: "Should we fight again on the spot or later?"

Zhang Ling said: "There are all of them."

Xu Liang said to the collegial panel: "Presiding judge, I'm done asking."

Peng Sheng looked at Wu You and said, "Defender, you can ask questions."

Wu You got up, greeted the collegial panel, and asked Zhang Ling: "Zhang Ling, can you describe the situation your mother was in at that time?"

Zhang Ling's eyes turned red when he recalled it for a while, and he said: "I think my mother was almost beaten to death, she was beaten to the ground covered in blood."

"Where did you get your knife?" Wu You asked.

"I got it from the kitchen." Zhang Ling replied.

"Did you go to the kitchen to get a knife?" Wu You asked.

"No, I was in a daze at the time and just wanted to stop my father. I unconsciously rushed into the kitchen, saw a kitchen knife, and took it out." Zhang Ling replied.

"How long has your father abused your mother and child?" Wu You asked.

"More than ten years. As long as I can remember, I remember that my mother and I were beaten by my father, and my mother was beaten for a longer time." Zhang Ling replied.

"What were you really thinking when you slashed at your father several times?" Wu You asked.

Zhang Ling was silent, and so was the huge courtroom.

After a while, Zhang Ling said: "I don't want to be beaten again, I don't want my mother to be beaten again,??I was afraid that my dad would hack my mom and me to death if he drank alcohol, or that one day, my mom and I would be beaten to death by my dad.  "

Wu You nodded heavily and sat back in his seat.

Peng Sheng said: "Now we are entering the stage of proof and cross-examination."

Xu Liang said: "The public prosecutor submitted the following pieces of evidence to the court regarding the facts of the allegations: 1. On-site inspection transcripts, 2. Identification transcripts, 3. Kitchen knife, 4. Expert opinion, 5. The defendant's confession and defense and  Simultaneous audio and video recording, etc."

Peng Sheng: "Do the defendants and defenders have any objections to the evidentiary materials submitted by the public prosecutor?"

"No objection." Zhang Ling and Wu You said in unison.

Peng Sheng said: "The defendant applied for three witnesses to testify in court, and now invites the first witness to appear in court."

The first witness was Mr. Hu, Zhang Ling's class teacher.

"Teacher Hu, please describe Zhang Ling's performance at school." Wu You said.

Teacher Hu was very nervous when she testified in court for the first time. She looked at the judge sitting in the trial seat and said, "I have been the head teacher of Zhang Ling for two years.  I have worked in education for more than 20 years, and I think my vision of children is more accurate."

Wu You continued to ask: "Do you think Zhang Ling has violent tendencies?"

Teacher Hu shook his head resolutely, and said: "No, Zhang Ling is very gentle. He has never had any disputes with anyone in the class. He even loves small animals and respects our teachers. There are not many children who are so well-behaved and sensible.  Yes, our teachers like him very much."

"Does Mr. Hu know that Zhang Ling continues to experience domestic violence?" Wu You asked.

"I know, because there are always big and small wounds on Zhang Ling's body. The old wounds are not healed, and new wounds are added. When I asked Zhang Ling, he always said that he fell by himself. Later, he couldn't hide it anymore, so he let go.  He was beaten by his father." After speaking, Teacher Hu gave Zhang Ling a sympathetic look.

"Thank you, Teacher Hu." Wu You said.

"Does the prosecutor need to question witnesses?" Peng Sheng asked.

"No need." Xu Liang said.  (Remember the site URL: www.hlnovel.com
